Terms of Service
By commissioning me, you are agreeing to the terms of service below. Any statement may be changed if discussed with me prior to paying for your commissioned piece.Please read the terms carefully.
Last Update: January 20241. GENERAL TERMS
• Prices are subject to change based on demand.
• The artist has the right to refuse a commission request that they are not comfortable with.
• The client shall provide references. Detailed description of the commission work is also highly encouraged.2. PAYMENT
• Payment(s) can be done through Paypal or Ko-Fi for international clients and GCash or Maya for local or PH clients.
• Commissions can be paid either 100% upfront or split 50% upfront and 50% before sending the final artwork.
• Only send any payment after receiving the artist's invoice.3. PROCESS AND DELIVERY
• The client will be notified when the artist has started the commission and the client, therefore, lose the rights to a refund (see point 6 for more info on refunds).
• The artist will make updates/reviews with the client to make sure that the commission piece is right for the client.
• The time it takes to finish the commission work varies 1 week - 2 months depending on the complexity of the commissioned piece, the workload, or personal issues of the artist.
• If anything comes up that will slow the progress of the initially estimated delivery time, the artist will inform the client.
• Once the artwork is finished, the client will receive the full-resolution image with a sign/watermark and one without.
• The final artwork will be sent as JPEG/PNG file through e-mail.
• The product is a digital file and does not require shipping.4. REVISIONS
• The artist will only allow 2 major revisions. Any extra revisions will have an additional $5 or Php 200.
• Revisions are only accepted during the sketching process.5. COPYRIGHT / USAGE POLICY
• The commissioned work is for personal use only. For commercial use, the client must discuss it with the artist. It will have additional charges.
• The artist has the right to post the commissioned work on their social media and portfolio unless the client doesn't give the permission and wants the commission to be private.
• The client cannot use the artist's work to train or produce AI artwork.
• The client must give credits to the artist if the commissioned work will be posted on any of their social media platforms.
• The client can print the artwork and claim the character(s) as their own, but not the artwork itself.
• The client is prohibited to reproduce, resell, edit or claim the artwork as their own.• I reserve the full rights to the image and its use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time).6. REFUND / CANCELLATION POLICY
• The client is not allowed a refund once the artist started working on the commission.
• If for any reason the artist is unable to start the commission work, the client will receive a full refund.
• If the client cancels their order before the artist started it, the client can get a full refund.
• The artist reserves the right to stop or cancel a commission work if the client shows inappropriate behavior or due to poor communication.
• If the client is getting a refund, do not request a Paypal chargeback. The artist will transfer the money back to the client themselves.
• If the client requests a Paypal chargeback at any point when they were not allowed to ask for a refund, the client will lose all beforementioned rights to the commissioned piece and the artist will have the full right to profit further from it in any way. The artist will decline the chargeback and supply Paypal with their conversations in which they talk about the commission as evidence that the artist have completed the work. Furthermore, the client will be blacklisted for commissioning the artist again.If the client breaks any of the points stated above, they will lose all the beforementioned rights to the artwork commissioned by me, Elaris (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. Any statement may be changed if discussed with me prior to paying for your commissioned piece.
